These terms of sale set out how Air Quality Premium — offered within the Air Quality app published by BAUGEY MATHEO (DEVOLIM) — is purchased, paid for, renewed and cancelled. They supplement the terms of use and are addressed to consumers.
1. Available plans
Premium — Monthly: subscription renewing automatically each month.
Premium — Yearly: subscription renewing automatically each year, preceded by a 7-day free trial (section 3).
Premium — Lifetime: one-off purchase, with no renewal and no further charge (section 8).
All plans unlock the same features: no advertising, alerts when air quality degrades and recovers, five-day forecasts, up to 50 followed cities, twelve months of history with CSV export, and exposure trends.
2. Price, currency and tax
The exact price is displayed in the app before any purchase, and again by the store at the moment of confirmation. It is set and charged by the App Store or Google Play, expressed in your local currency according to the store's pricing grid and your billing country. The final amount, including any applicable taxes, is the one shown by the store before you confirm.
Under Article 293 B of the French General Tax Code: VAT is not applicable. Where the store acts as the party liable for tax in the user's country, the amounts applied are those it displays.
3. Free trial
The yearly plan begins with a seven (7) day free trial. The monthly plan includes no trial. During the trial, all Premium features are available at no charge.
At the end of the trial period, the yearly subscription continues automatically and your Apple or Google account is charged at the then-current rate, unless you cancel at least twenty-four (24) hours before the trial ends. The trial is reserved for users who have not already benefited from it and can be used only once per store account. Cancelling during the trial is free of charge (section 5).
4. Payment
Payment is made exclusively through the Apple or Google account linked to the device, depending on the store used to download the app. The Publisher neither collects nor stores any payment data and receives neither your identity nor your billing address. Purchase verification is carried out by the provider RevenueCat, as described in the privacy policy.
The purchase receipt is issued by the relevant store, which alone is able to produce the corresponding invoice.
5. Automatic renewal
Monthly and yearly subscriptions renew automatically: your Apple or Google account is charged at the then-current rate at each renewal date, unless cancelled at least twenty-four (24) hours before the end of the current period, in line with the stores' rules.
Under Articles L.215-1 et seq. of the French Consumer Code, you may cancel at any time, free of charge and without penalty, with effect at the end of the current period.
6. Cancellation
Cancellation is carried out from the store account that recorded the purchase:
- iOS: Settings → [your name] → Subscriptions → Air Quality → Cancel subscription. Direct link: apps.apple.com/account/subscriptions
- Android: Google Play → profile → Payments and subscriptions → Subscriptions → Air Quality → Cancel. Direct link: play.google.com/store/account/subscriptions
Cancellation takes effect at the end of the period already paid for: Premium features remain available until that date, with no further charge. Uninstalling the app does not cancel a subscription. When a subscription expires, cities saved beyond the free limit are kept but become inactive; they are restored if you subscribe again.
7. Restoring purchases
If you reinstall the app or change device, your subscription can be restored from the subscription screen using "Restore purchases", provided you use the same Apple or Google account as at the time of purchase. Because the stores are separate ecosystems, a purchase made on the App Store cannot be restored on an Android device, and vice versa.
8. Lifetime purchase
The lifetime option is a one-off, non-renewing purchase granting access to Premium features with no time limit and no further charge, for the Air Quality app and for the store account that made the purchase.
This access is granted for the period during which the app is operated by the Publisher. It is personal and non-transferable, does not extend to other apps by the Publisher, and does not prevent features from evolving as provided in section 8 of the terms of use. Should the service be permanently discontinued, the Publisher would inform users within a reasonable period; consumers' statutory rights, in particular the guarantee of conformity for digital content, remain applicable in any event.
9. Right of withdrawal — express waiver
Under Article L.221-28, 13° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to digital content not supplied on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of that right.
By subscribing to Air Quality Premium, you expressly request immediate supply of the digital content and expressly waive your right of withdrawal as soon as the features are unlocked. This waiver does not affect your ability to cancel at any time (section 6), nor the statutory guarantees set out in section 10 of the terms of use.
10. Refunds
As purchases are collected by the stores, refund requests are governed exclusively by their respective policies:
- Apple: reportaproblem.apple.com
- Google: support.google.com/googleplay
The Publisher has no technical means of issuing a refund itself, but can assist you with the process. This limitation does not prevent statutory guarantees from being invoked directly against the Publisher.
11. Price changes
The Publisher may change prices for future subscription periods. Any change affecting an ongoing subscription is notified by Apple or Google, within the timeframes and in the manner provided by those platforms; failing acceptance, the subscription ends at the close of the current period, free of charge. Lifetime purchases already made are unaffected.
12. Complaints, mediation and governing law
Any complaint relating to a subscription may be sent to contact.airquality@devolim.fr. Consumers may use a consumer mediator free of charge (Articles L.611-1 et seq. of the French Consumer Code) as well as the European online dispute resolution platform: ec.europa.eu/consumers/odr.
These terms are governed by French law, without prejudice to the mandatory consumer protection provisions applicable in the consumer's country of residence.
13. Language
This English version is provided for convenience. In the event of any discrepancy, the French version shall prevail.
